This is regarding the complaint of Rodolfo M. Cunanan about his permanent total disability claim, which was denied by Social Security System Tarlac (“SSS member entitled to permanent total disability benefits,” Letters, 8/9/13).
According to SSS Tarlac, Cunanan’s SSS and EC Total Permanent Disability Claim applications were initially denied on May 19, 1998, because there was no progression in his work-related illness.
Upon appeal to the Employees’ Compensation Commission, his EC Total Permanent Disability benefit was granted in August 2010 and was applied retroactively starting July 21, 1997.
However, the approval of his claim under the Employees’ Compensation Law (Presidential Decree No. 626, as amended) is not a pre-requisite for the approval of his claim with the SSS. The conditions provided under the SSS Law for the availment of benefits are separate and distinct from that of PD 626, as amended.
We advise Cunanan to visit SSS Tarlac for them to further explain this matter.
