The reported road rage incident in Cebu City, if accurate, is one for the books (“Cebu road rage case must wait in line, says prosecutor,” News, 3/23/17). In my 20 years of service as an investigator of the Criminal Investigation Service of the now defunct Philippine Constabulary in Camp Crame, I did not come across a case like this, where a bullet propelled itself and hit the victim without, perhaps, the use of a firearm.
Hence, a case of frustrated homicide and illegal possession of ammo were filed by the Prosecutor’s Office of Cebu against the suspect. Oh my God! What is happening to our justice system? Please, my dear Mr. Prosecutor, educate us nonlawyers why the flashing of a gunfire aimed toward the victim, as shown on TV, was not taken into consideration. Could it be that the firearm is still missing and only the ammo was recovered and used as evidence by the police?
This offers a way out for future offenders who will throw to the sea an unlicensed firearm to avoid an additional case of illegal possession of firearm after killing the victim, in spite of the fact that witnesses and TV cameras can attest to the use of a gun.
