Recall of Fasap ruling issued en banc

This is in reply to the letter of Bob Anduiza, Andy Ortega and Ricky Montecillo. (Inquirer, 1/11/12) To clarify, the “Recall” order dated Oct. 4, 2011 that Fasap is referring to was issued by the Supreme Court en banc unanimously and not merely by one justice, let alone Chief Justice Renato Corona. Those members of the Second Division who issued the order that was recalled, the one issued on Sept. 8, 2011, were among those who voted for its recall.

The order of Oct. 4, 2011 is now the subject of a Motion for Reconsideration by Fasap. PAL, who was ordered by the Court to comment on the Motion for Reconsideration, has already submitted its comment. This matter is now deemed submitted for resolution and in pendente lite. For Fasap to perpetuate this kind of erroneous conclusions is legally wrong.

Fasap should refrain from arguing its case in the media.
