What CA resolution says: BSP erred in shutting down Banco Filipino

This refers to the news article titled “Latest ruling keeps Banco Filipino shut.” (Inquirer, 2/27/12) Marlon Ramos, who is the author of this report, has no business misleading the public with erroneous reporting. His lead sentence was, “Which is which?” implying inconstancy on the part of the Court of Appeals. Of course, this is not the fact.

It is appalling why the editors did not bother to fact-check this news article before printing it. This blunder shows Ramos or the editors were clueless about the Court of Appeals resolution which denied the motion for reconsideration of the losing party.

The latest resolution simply means that there was no reason for the Court of Appeals to disturb its earlier finding that there was grave abuse of discretion amounting to lack of jurisdiction of the Regional Trial Court which ordered the closure of Banco Filipino.

Simply put, Banco Filipino should not have been shut down by the Bangko Sentral ng Pilipinas.
